William H. Dulaney, III gained his construction experience first hand, in the field. For ten years, Bill dealt with the same problems that continue to confront contractors in heavy, industrial, and commercial construction. He bid jobs, wrote contracts and purchase orders, scheduled projects, processed submittals, applied for payments, and dealt with safety issues from a contractor’s perspective. He fought to win jobs when they were wrongfully awarded to other companies by city counsels and state agencies. He brings this unique experience to help his clients navigate an increasingly difficult maize of government regulations and contract procedures to win, build, and deliver quality projects in a timely manner for a fair price.
For over twenty years, Bill has assisted contractors in setting up their business from selection of the right business entity to finding bankers and bonding agents that understand the construction industry and a client’s specialized needs. Bill understands from the practical perspective that being counsel to a construction company is more than just showing up after a project begins to go bad. He has experienced problem projects, from delayed material deliveries, bad soils, and bankrupt subcontractors to architects, engineers, and owner representatives that punish contractors with unrealistic expectations and mountains of self serving documentation, and he uses this knowledge for his clients.
Bill represents clients dealing with public construction contracts throughout Ohio and the southeast United States. He has dealt with state Departments of Administration and Transportation contracts as well as Federal procurement contracts for civilian and military agencies, as well as Boards of Contract Appeals. Likewise, Bill frequently lectures on topics such as state prevailing wage law, the Davis-Bacon Act, and the Service Contract Act wage provisions. He has also litigated both state and federal wage issues in state and federal courts.
With his personal insight into construction processes, Bill continues to represent clients before, during, and after OSHA general and specific inspections. Bill has dealt with construction site accidents as a contractor and continues to bring his insight to clients in areas including limitation of inspections, fall hazards, scaffolding and open trenching issues. Bill has even dealt with safety discrimination based claims made by underperforming employees.
Most importantly, Bill has established a network of resources to assist contractors in scheduling, claims preparation, safety training, and construction management. Educating contractors is an important personal goal for Bill, and he frequently teaches construction law courses, not only for executives, but for the front line managers/foremen that are at the first contacts of a contractor on a project.
